Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the services provided by NTIT ("we", "us", or "our"), a web design and development business registered in South Africa (Reg. 2026/0410215893083/07) and located at Krugersdorp, Gauteng, 1754. By engaging our services or entering into an agreement with us, you ("Client") agree to be bound by these Terms.

Please read these Terms carefully before proceeding. If you do not agree, you should not engage our services.

2. Our Services

NTIT provides web design and development services, including but not limited to:

  • Custom website design and development
  • Responsive and mobile-optimised websites
  • Search engine optimisation (SEO) foundations
  • Website launch and deployment assistance
  • Post-launch maintenance and support (where agreed)

The specific scope of work for each project will be set out in a written proposal or service agreement agreed upon between NTIT and the Client prior to commencement.

3. Our Guarantee — Presence, Not Leads

NTIT guarantees the delivery of a professional, functional website that establishes your business's online presence in accordance with the agreed project scope. We do not guarantee specific business outcomes such as the generation of leads, enquiries, sales, or a particular level of web traffic.

Results from a website depend on many factors outside our control, including market conditions, the nature of the client's business, ongoing marketing activity, and search engine algorithm changes. We build the platform; the results depend on how you use it.

4. Payment Terms

Unless otherwise agreed in writing, the following payment terms apply:

  • A non-refundable deposit of 50% of the R 1 200 setup fee (i.e. R 600) is required before work commences.
  • The remaining R 600 balance is due upon go-live, before the site is handed over or published.
  • The monthly subscription of R 199/month begins from the date the site goes live and is billed on a recurring basis.
  • Invoices are payable within 7 (seven) days of issue unless an alternative arrangement has been agreed in writing.
  • Late payments may attract interest at the rate of 2% per month on the outstanding balance.

5. Client Responsibilities

To allow NTIT to deliver the project on time and to the agreed standard, the Client agrees to:

  • Provide all necessary content, images, logos, and other materials within the timeframes agreed upon.
  • Respond to communication and approval requests within 5 (five) business days.
  • Provide accurate and complete information about the business and its requirements.
  • Obtain all necessary rights or licences for any content or materials supplied to NTIT.

Delays caused by the Client's failure to meet these responsibilities may result in revised timelines and, where significant, may attract additional fees.

6. Revisions and Changes

Each package includes a defined number of revision rounds as specified in the project proposal. Additional revisions beyond the agreed scope will be charged at our standard hourly or per-revision rate, which will be communicated in advance.

Changes to the project scope after work has commenced (including additional pages, features, or functionality not included in the original proposal) will require a written change request and may affect the timeline and cost.

7. Intellectual Property

Upon receipt of full payment, the Client is granted full ownership of the final website design and content created specifically for the project. NTIT retains the right to:

  • Display the completed project in our portfolio and marketing materials.
  • Retain ownership of any reusable code, frameworks, or tools used in the development that are not specific to the Client's project.

Any third-party assets (fonts, stock images, plugins, etc.) used in the project remain subject to their respective licences.

8. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project, and not to disclose such information to third parties without prior written consent, except where required by law.

9. Limitation of Liability

To the fullest extent permitted by applicable law, NTIT shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with our services, including but not limited to loss of revenue, loss of business, or loss of data.

Our total liability to you for any claim arising from our services shall not exceed the total amount paid by you for the specific project giving rise to the claim.

10. Termination

Either party may terminate the project agreement with 14 (fourteen) days' written notice. In the event of termination:

  • The Client remains liable for payment of all work completed up to the date of termination.
  • The deposit is non-refundable in all cases.
  • Partial deliverables will only be handed over to the Client once all outstanding amounts have been settled.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or our services will be subject to the jurisdiction of the South African courts.

12. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be effective from the date of publication on our website. Continued engagement of our services after any changes constitutes acceptance of the revised Terms.
